The contested TNRCC
permit for Charles Patterson, doing business as Southerland Properties, was
reviewed. Several persons who contested
this permit were present. Southerland Properties
has proposed limiting the pumping from the Guadalupe River contingent upon
river flow rates as follows:
River
flow 77 cubic feet per second (cfs) between July 1 and February 28
River
flow 121 cfs between March 1 and June 30
The Northwest Environmental Coalition, a local grassroots organization, may be interested in this permitting process. Southerland Properties has 3 sources of water: Guadalupe River, ground, and the pipeline from Canyon Lake to San Antonio.
Thomas J. Fatjo has
purchased 32 acre-feet of water per annum from GBRA and has applied for a TNRCC
permit in Kerr County. Again, a letter
writing campaign will be needed to contest this permit.
The Texas River
Protection Association will probably join our cause if we show effort in trying
to resolve this TNRCC permitting problems.
Stephen Grigory, a
local retired professional engineer, presented how the river flow affects the
aquifer mechanics in the Spring Branch area.
John Hohn, an
attorney from San Marcos, proposed several questions for GRA board members to
decide on how to proceed with this TNRCC permitting of the above two
requests. Mr. Hohn stated he usually
works for $150 per hour, but when working on environmental issues he charges
around $90 per hour. Guy Anderson posed
to the present members to continue working on this issue on our own or to
purchase counsel to assist our efforts in proposing the TNRCC permits.
Fred Rose motioned to get a qualified lawyer to represent Guadalupe River Association in opposition to the TNRCC permits for Sutherland Properties and Fatjo spending up to $1500 for this counsel seconded by Mark Zuercher. Motion Carried.
The GRA bylaws need updating to reflect the changes that have occurred since inception of this organization. The bylaw review committee consists of Mark Zuercher, Lucky Wilson, Donna Pool, and Guy Anderson.
The annual General Membership Meeting will take place in late January. The location was discussed.
Brenda Lindemann motioned to have the January meeting on a Saturday, paying the $140 fee, here at GVTC conference hall seconded by Judy Davenport. Motion Carried.
To entice member attendance, GRA could supply the meat and have members bring a side dish.
